In the event of any discrepancy between the original Dutch version and this English translation, the Dutch language version shall have precedence.
Below you will find our terms and conditions.
As with all terms and conditions, these get a bit technical and we’re sorry if they sound rather formal. However, they are pretty standard and designed to enhance your e-shopping experience and make it as easy and secure as possible.
The terms and conditions apply to the use of the webshop www.fates.nl. By placing an order with us, you are agreeing to accept these terms and conditions (The Conditions).
Please note, these terms and conditions can potentially change at any time, and it is up to you to check these terms and conditions regularly before ordering products in case there are any changes. If you do not agree with the terms and conditions set out below, you should not use or access this website.

These conditions apply to any business conducted with you and FATES B.V. (Netherlands) , hereinafter called FATES. By placing an order you accept these terms and conditions.
FATES reserves the right to revise terms of delivery and/or payment.
Terms of Agreement
You can place an order following the instructions as stated on our service page under the heading Shopping at FATES.
FATES reserves the right to refuse an order or to apply certain conditions to delivery. We will not accept your order if the delivery or billing address is incorrect. The order is only accepted once you receive a confirmation email from FATES.
Liability
FATES does not accept liability for any indirect loss, consequential loss, loss or damage to property and/or loss from claims of third parties for any products purchased from FATES.
Prices and costs
All prices in the FATES webshop are inclusive of 19% tax.
All prices stated are exclusive of delivery and administration costs.
For deliveries with The Netherlands the delivery and administration costs , irrespective of weight, are €5.00 per order.
For deliveries within the EU and Switzerland €12.00 and for the rest of the world, €20.00
If your delivery address is outside of the Netherlands, you may have to pay import duties and taxes, which are levied once a shipment reaches your country. You must meet any additional charges for customs clearance. Please note, customs policies vary widely from country to country. We recommend you contact your local customs office for further information.
Please note international shipments may be subject to cross-border inspections by customs authorities.
FATES reserves the right to revise these costs at any time.
Special offers and Promotions
You can not make use of a special offer or promotion once it has exceeded its expiry date. FATES has the right to reserve certain offers for regular customers only
Delivery
FATES will exercise every care in processing orders and sending out the ordered items.
FATES will despatch accepted orders as quickly as possible in order of receipt. In general, delivery is within 14 days after the order has been received.
If we are unable to make a delivery or ensure delivery within this time period, you will be notified no later than 14 days after your order is placed.
FATES is not liable for any damages whatsoever resulting from the overruning of the given deadlines.
There can be no liability accepted in the case of a delivery being accepted by another person, who is not the addressee but is present at the given address.
There is a maximum delivery time of six weeks. Should the delivery arrive after this stipulated period, the consumer has the right to cancel the order, without compromising his/her rights.
Delivery of delayed items
It will sometimes happen that an item is temporaily out of stock or that delivery to FATES is unavoidably delayed. To avoid this delaying the despatch of other items in your order, we will despatch these immediately.
We will despatch the delayed article as soon as we have it, without you incurring extra postage costs.

In the event that a delivery is no longer possible, you will receive notification from us and your order will be cancelled. Payment already made will be returned as quickly as possible, in any event within 30 days.
Right to Cancel
You have up to 14 days to approve your purchases. You can cancel this contract if you so wish, provided that you exercise your right to do so within the 14 days. During this 14 day period you have the right to return the items, without effecting your statutory rights. In the case of returning an item, use the enclosed address label and return the items to us in their original and unused state, following the procedure as set out in the service pages in the FATES web shop under the heading “Exchange and Returns.” You will receive a full refund, less delivery costs, within 30 days.
In the unlikely event that you receive goods which were not what you ordered or which are damaged or defective, or are of a different quantity to that stated on your order form, you need to return this to FATES. You can use the returns address label enclosed and FATES will reimburse you for the postage costs.
Transport Guarantee
All orders for delivery, despatched by FATES within the Netherlands are insured by FATES and sent by a courier service. If a parcel arrives damaged, please do not open it but inform FATES Customer Services immediately.
Age Limit
You must be eighteen years or older to use this site.
Privacy
By placing an order you are simultaneously giving FATES permission to use your personal details as required.
Your details will only be retained by us insofar as is necessary for FATES to realise the objectives for which processing this data is necessary. As well as fulfilling a specific order as part of our agreement, these objectives will also be understood to include marketing purposes and the maintenance of customer relationships . Personal details given by you to us will never be passed on to third parties for commercial purposes without your express permission. You always have the right to view and correct your personal details held by us.
Complaints and Customer Protection
Should you at any time be less than delighted with any of our products or our services, please do not hesitate to contact us. If you should wish to make a complaint, please call or email us as soon as possible so that we can do our utmost to resolve the problem.
Payment
You can pay via Multisafepay or Paypal. Please follow the procedure set out under “Shopping at FATES”.
Creditcard
We accept all creditcards with the Visa or Mastercard symbol. All credit and debit cardholders are subject to validation checks and authorisation by the card issuer. If the issuer of your payment card refuses to authorise payment to us, we will not be liable for any delay or non-delivery.
All transactions on our website are, in the interests of customer safety, held in an encrypted format.
Liability
FATES accepts no liability for damages other than for those damages covered by their liability insurance policy and where the insurer accepts the claim.
In any other cases liability is limited to the maximum cost of the purchase price of the article/articles. In no case whatsoever shall any claim exceed 2.500 euros.
FATES can never be held liable for consequential loss.
Circumstances beyond our control/ force majeur
In the event of a situation occurring which is beyond our control, all obligations on behalf of FATES are suspended. Should this situation continue for longer than two months, both you the consumer and FATES have the right to annul the agreement, without any obligation to pay damages. In circumstances of unforeseesable events , such as strikes, employee sickness, transport disruptions and import/export embargos, neither the supplier nor FATES is liable for damages.
